Status of the Site Remediation Program

Earlier this month, Assistant Commissioner of NJDEP’s Site Remediation Program, Mark Pedersen, gave an update on the status of the Site Remediation program.  He spoke about the progress of the program thus far, discussed areas of the program that need improvement, and provided information about current initiatives to make the program more successful. Some of the major points that he made are summarized below:

  • Currently, there are 10,345 Active LSRP cases. 2,180 cases have already been closed.
  • 3,305 RAOs have been filed, and inspection/review has been completed for 2,736
  • One of NJDEP’s major goals is to stream-line the program and to provide tools to help LSRPs succeed.
  • NJDEP proposes renewed focus on receptors: NJDEP will set up a unit to manage all IECs and VCs. It will set up a “Receptor Survey Team”
    •  Immediate Environmental Concerns
    • Vapor Concerns
  • NJDEP plans to make regulatory changes to ensure continued success:
    •  ARRCS: N.J.A.C. 7:26C
    • Numerous clarifications
    • UST Rules: N.J.A.C. 7:14B
    • RAOs for “clean” tank pulls
    • ISRA Rules: N.J.A.C. 7:26B
    • de minimis not required to certify no contamination
    • Proposed New Chapter = Heating Oil Tank System Remediation Rules
  • NJDEP plans to engage in ongoing assessment of the Program. It will:
      • Identify impediments to LSRP success
      • Use RAO questions and withdrawals to focus assistance, guidance, training
      • Identify future leaders and managers in the program
