Have you noticed your NJDEP Annual Remediation Fee or Permit Fee increase? Do you think you were billed incorrectly? Are you aware that as of July 1, 2014 the three main categories of fees: Annual Remediation Fees, Remedial Action Permit Annual Fees and Remedial Action Permit Activity Fees were revised? Sorry to inform you, but the fees have changed!
All category and contaminated medial fees have increased for Fiscal Year 2015. For example a site listed as Category 2, such as an regulated UST site, would have a fee increase from $900 to $1,130 and a contaminated media fee increase from $1,400 to $1,750. This would bring the total Annual Fee for a Category 2 site to $2,880 resulting in a total fee increase of $580. All Soil and Ground Water Remedial Action Permit Fees have increased with the exception of the Ground Water Permit Termination Fee which decreased.
Remember, if an LSRP issued a Response Action Outcome (RAO) for specific Areas of Concern (AOC), you can reduce your annual remediation fee if you go down by a category, i.e. from Category 3 to 2. Also, if you receive a Remedial Action Permit and the LSRP issues a Limited Restrictive RAO (assuming no other AOCs exist on the site), you will only pay permit fees and no annual remediation fees.
