NJDEP Issues Order Effective February 1, 2021 That Extends Site Remediation Deadlines

The NJDEP Notice of Rule Waiver/Modification/Suspension provides relief to Persons Responsible for Conducting Remediation (PRCR) who were facing regulatory and mandatory timeframes in 2021. These remediating parties received a limited extension for regulatory and mandatory timeframes to complete remediation from May 6, 2021 to May 6, 2022.

The NJDEP is extending the regulatory and mandatory timeframes that are or will be reached during the ongoing COVID Health Emergency for a total of 455 days from the original deadline. The Order, available here, does not extend timeframes applicable to circumstances where immediate environmental concerns (IEC) exist or human or sensitive receptors are or may be impacted.

It is very important to note that in order to qualify for the extensions outlined in the Order, the PRCR must have retained a licensed site remediation professional (LSRP). To discuss the specifics of your site, to retain an LSRP or for further information contact Brilliant.
