Retail Gasoline Service Station

Washington Township, Gloucester County, New Jersey

A retail petroleum station owner wished to sell a property which was impacted by hydrocarbon contamination in soil and groundwater. Brilliant Environmental Services, LLC (BES) was hired by a potential buyer of the property to evaluate the environmental liability associated with the site, and assist in establishing the fair market value of the property. BES concluded that even though the site had been undergoing extensive remedial actions for over twenty years, the site remained contaminated, and the cost to complete the remediate was significant. Based upon BES’s investigations our client was able to successfully negotiate a sales agreement for the property, without assuming the liability associated with the environmental condition of the site.

 

Upon completion of our work, the seller of the property was sufficiently impressed with our work to retain BES, with the prior approval of the buyer of the property, to provide the seller with expert legal testimony, environmental compliance and remediation services at the site.

Retail Service Station

Manalapan, Monmouth County, New Jersey

Brilliant Environmental Services, LLC (BES) was retained by a major retail gasoline company, to complete vapor intrusion investigation at residential properties.

 

Elevated levels of volatile organic compounds (VOC) were detected in monitoring wells above the New Jersey Department of Environmental Protection (NJDEP) Vapor Intrusion Guidance Document Screening Levels and criterion within proximity to the residential dwellings. 

 

As part of the vapor intrusion investigation(s), BES collected sub-slab soil gas samples, as well as, indoor air samples. BES coordinates the quarterly sampling with the client, off-site property owner and/or tenants, and laboratory. Sampling events are typically completed over a 24-hour period.

Homeowner Tank Remediation Projects

Major National Insurance Company

New Jersey

Brilliant Environmental Services, LLC (BES) provides soil and groundwater remedial investigation services for a nationwide homeowner’s insurance company.

 

Upon removal of home heating oil underground storage tanks (UST) that are found to be leaking BES will complete soil sampling and groundwater sampling through the installation of temporary wells to determine if contamination is present above applicable standards. Following confirmation that contamination is present BES completes soil delineation of the area affected by the release from the UST. Typically soil borings are completed on all four sides of the area of concern and samples are collected to document the delineation. The delineation results are used to determine the remedial strategy. Following the completion of soil remediation BES completes the post-remedial groundwater investigation through the installation and sampling of permanent monitoring wells.

Homeowner Tank Remediation Project

Lacey Township, Ocean County, New Jersey

Brilliant Environmental Services, LLC was retained by the homeowner to provide remediation services for the release of No. 2 Heating Oil from a former 275-gallon underground storage tank and subsequent release for the replacement 275-gallon above ground storage tank. The location of the release was adjacent a one-story home which resulted in the release migrating beneath the dwelling. Subsurface conditions would not allow for structural support in place, therefore the house was moved and staged at the rear of the property to perform the required remediation. The total depth of the remediation was approximately eight and one-half (8.5) feet below grade and yielded close to 160 tons of contaminated soil and 1,700 gallons of impacted groundwater.

 

Upon completion of soil remediation the site was restored to it pre-remedial state, including topsoil, grass seed and hay and the replacement of all utilities. BES completed post remedial soil and groundwater sampling as well as reporting to the New Jersey Department of Environmental Protection.

Retail Service Station

Freehold, Monmouth County, New Jersey

Brilliant Environmental Services, LLC (BES) was retained to provide on call environmental services by a major retail gasoline company. BES was requested to complete immediate response activities associated with the report of gasoline type odors, emanating from a storm sewer catch basin. A delivery ban prohibiting the delivery of fuel to the site was imposed pending the results of the investigation.

 

BES coordinated its response efforts with the client, the client’s tank system testing contractor, and local and state officials. BES screening all accessible utility opening using a photo ionization detector (PID) and combustible gas meter. Following review of the utility screening results and the tank system testing results state and local officials lifted the delivery ban and the station resumed operations.

LukOil North America, LLC

Manalapan, Monmouth County, New Jersey

Brilliant Environmental Services, LLC was retained by a major retail gasoline company, to complete groundwater and soil vapor extraction, system operation and maintenance and periodic groundwater monitoring.

 

Groundwater sampling is completed on a quarterly basis pursuant to New Jersey Department of Environmental Protection regulations. The existing monitoring well network consists of 46 on and off-site wells. BES coordinates the quarterly sampling activities with the client, off-site property owners, and the laboratory. Sampling events are typically completed over two to three days on-site. 

 

The remediation systems are monitored on a weekly basis to ensure peak performance and compliance with permit requirements. Soil vapor is extracted from selected SVE wells and treated using a catalytic oxidizer. Groundwater is pumped from selected recovery wells and treated using a shallow tray air stripper and granular activated carbon.

Gulf Oil Limited Partnership Terminal

Mechanicsburg, Pennsylvania

Gulf Oil Limited Partnership is a wholesaler of refined petroleum products, which operates petroleum distribution terminals throughout the northeast. Gulf Oil distributes motor fuels through a network of 1,800 Gulf branded retail gas stations, as well as heating oil, kerosene and diesel fuel. 

 

Brilliant Environmental Services, LLC (BES) provides Gulf Oil environmental compliance, consulting and remedial services in Pennsylvania and New Jersey. In doing so, BES works directly with the Pennsylvania Department of Environmental Protection, New Jersey Department of Environmental Protection and United States Environmental Protection Agency.

A Jersey Shore Marina

Monmouth County, New Jersey

Underwater excavation is called dredging. Many times an initial excavation is needed to establish a ship channel within a river or harbor. The periodic dredging that must be done to keep it clear and safe for navigation is called maintenance dredging. Port terminals and boat marinas must remove sediments on a regular basis. Sometimes contaminated sediments must be removed or capped to limit the release of contaminants. Once sediments are dredged from the waterway, they are called dredged material.


Brilliant Environmental Services, LLC (BES) worked with a Monmouth County marina owner to complete appropriate pre-application sampling and meetings, in preparation for the submission of Army Corp and NJDEP permits for dredging. Working with NJDEP the dredged material was deemed suitable for use on a redevelopment project in New Jersey, so not only did the project improve the marina use, but the reuse of the material assisted economic development. BES collected all samples for the project and prepared all permit applications.

Veterans Administration CARES

Phoenix, AZ; St. Louis, MO; Montrose, NY; Castle Point, NY; Marion, IN; and Lincoln, NE

The Department of Veterans Affairs retained the services of our team to provide expert real estate advisory services including environmental for the redevelopment of properties located on various medical campuses throughout the United States. The goal of this Task Order (TO) is to provide the Department of Veterans Affairs (VA) with expert advisory services including transaction analysis, consultation, recommendations and negotiations on: environmental, valuation, legal, and management, technical, financial and real estate market issues, and the drafting of required documents for the redevelopment project at VA Northern Indiana Health Care System (VANIHCS) Marion, Indiana Campus. The real estate advisor (Contractor) will provide real estate analysis and transaction assistance that accomplishes the execution of an Enhanced-Use Lease (EUL) on the site that is awarded to a preferred lessee that maximizes the benefits and potential savings to VA. 

 

Brilliant Environmental Services, LLC (BES) conducted a site inspection to review the environmental issues on site, to obtain visual evidence of the likelihood of the presence of any hazardous substance or petroleum products that indicate an existing or past release or a threat of a release onto the property. We then prepared a Phase 1 Environmental Assessment / All Appropriate Inquiries (AAI) and an Environmental Impact Statement (EIS), focusing on the impact for successful future redevelopment efforts.

Christ United Methodist Church

Lakewood Township, Ocean County, New Jersey

Christ United Methodist Church contracted with Brilliant Environmental Services, LLC (BES) to complete a Preliminary Assessment in accordance with New Jersey’s requirements for new child care facilities. Since the request post-dated the change in NJ environmental regulations, a Licensed Site Remediation Professional (LSRP) was required to either complete the site activities or oversee the work.

 

Philip I. Brilliant, CHMM, LSRP of BES was retained by Christ United Methodist Church to oversee the site activities, including the completion of a Preliminary Assessment in accordance with NJAC 7:26E and prepare a report. Since the investigation revealed no areas of concern (AOC), in addition to completing the Preliminary Assessment Report, Mr. Brilliant completed a Response Action Outcome (RAO) for the project. In accordance with the Site Remediation Reform Act (SRRA) and the Administrative Requirements for Remediation of Contaminated Sites (ARRCS) NJAC 7:26C, a RAO is equivalent to a No Further Action (NFA) letter issued by NJDEP. 

 

From date of retention to preparation of an RAO the entire project was completed in 18 business days.

Toms River, New Jersey 

Expert on behalf of Defendant, retained to review remediation completed by Township of Toms River in evaluation of property for Taking, including collection of soil samples to verify data and present independent estimate of cleanup costs. Prepared cost estimates and expert report for review by all parties. Remediation completed. 


New Jersey Turnpike Authority (BEM Systems) 

Montvale, Bergen County, New Jersey 

Brilliant Environmental Services, LLC (BES) is the industry leader in mobile and stationary Multi-Phase Recovery Remediation (MPR), otherwise known as High-Vacuum Extraction.  BES mobilized a unit to the project site and operate the unit for an 8 hour event. BES utilized an onsite storage tank to store all liquids recovered, while treating all vapor phase hydrocarbons using the internal combustion engine (ICE).  BES units are permitted by NJDEP, as well as other local and state agencies, so as to operate units in multiple states.  BES units also have the capability of providing mobile or immediate air-sparging services, using the unit on board compressor, so the units are not only capable of extracting hydrocarbons, but increasing volatility by sparging.  BES MPR reports are available within two weeks of system shut-down. 


Cityworks to Weiss Realty, LLC 

Neptune Township, Monmouth County, New Jersey 

West Lake Avenue, located in the Township of Neptune, was the former commercial corridor, primarily serving the needs of local residents. The Avenue was once the home to a number of successful businesses and a thriving social scene.


CityWorks, a not-for-profit developer, was selected by the Township to revitalize West Lake Avenue, and restore its function to the neighborhood. The project was given a Brownfields Development Area (BDA) designation in 2006 by the New Jersey Department of Environmental Protection. BES is working with City Works to guide them through the Brownfields process, identifying the environmental concerns associated with over 40 properties; targeting and securing the funding options available for remediation and redevelopment. BES has approached the project on an area-wide basis to maximize resources and streamline remedial efforts. 


CityWorks was able to obtain the No Further Action (NFA) letter with the remediation work completed by Brilliant, however the NFA was conditional due to residual groundwater contamination. The groundwater contamination was from the former use of chlorinated solvents on site and a classification exception area (CEA) was established at the time of the NFA. Weiss Realty purchased the property following CityWorks financial decline and retained Brilliant to complete remediation and for the Brilliant LSRP to issue an Unrestricted RAO. Brilliant was able to complete additional groundwater sampling, install a monitoring well and complete additional remediation to achieve groundwater standards and lift the CEA and issue an Unrestricted RAO.

Paramount Homes 

Upper Freehold Township/Millstone Township, Monmouth County, New Jersey 

Brilliant Environmental Services, LLC (BES) was retained by Paramount Homes to complete remediation of pesticide and arsenic contaminated soils at a farm. The client planned to redevelop the farm for single-family residential use. The remediation was completed “at peril” with limited oversight by the New Jersey Department of Environmental Protection (NJDEP). The NJDEP issued the No Further Action letters in February 2008 for the soil remediation.   


Upon adoption of the Site Remediation Reform Act (SRRA) all sites with restricted No Further Action letters were required to obtain a Remedial Action Permit and establish Financial Assurance.  Brilliant’s LSRP worked with Paramount Homes to complete the RAP application and satisfy the NJDEP requirements. 


As part of the development process, a variance was needed from the local zoning board to develop a lot for residential use. BES provided project information, such as reports, timelines, and a description of the work completed to the local zoning board and environmental commission for the client. BES appeared before the Millstone Township Zoning Board to provide testimony on the project timeline and the technical aspects of the remediation.

Homeowner Tank Remediation Project

Wall Township, Monmouth County, New Jersey

Brilliant Environmental Services, LLC was retained by the homeowner to provide remediation services for the release of No. 2 Heating Oil from a former 1,000-gallon underground storage tank. The location of the release was between a two-story home and a swimming pool and not only impacted soil but also groundwater. The total depth of the remediation was approximately thirty (30) feet below grade and yielded close to 1,300 tons of contaminated soil. BES utilized a combination of a triple bay slide rail system; thirty (30) feet of sheeting wall and eight (8) helical piers to provide adequate structural support for the duration of the project.

 

In addition to soil remediation, the removal of a natural gas line, the relocation of an above ground storage tank (AST) and disconnection and temporary removal of two air condition units was required. Upon completion of soil remediation the site was restored to it pre-remedial state, including topsoil, grass seed and hay and the replacement of all utilities. Post remedial soil and groundwater sampling as well as reporting to the New Jersey Department of Environmental Protection were completed by others.

Brownfields Redevelopment Project

90 Halsted Street, East Orange, Essex County, New Jersey

As the environmental consultant for the City of East Orange, Brilliant Environmental Services, LLC (BES) completed a Preliminary Assessment (PA), and Site Investigation (SI), to obtain a No Further Action (NFA) letter for a city-owned property. The property is occupied by an abandoned commercial building and the City of East Orange intends to rehabilitate for use as a Senior Center. BES completed a PA, which includes a review of the site history and inspection of the building interior and exterior areas of the property to identify potential environmental areas of concern (AOC). A SI was completed to investigate AOC identified during the PA.

 

BES also inspected the structure for asbestos containing materials (ACM) and lead-based paint (LBP). Building materials containing asbestos and surfaces painted with LBP were positively identified for proper abatement prior to rehabilitation activities. BES will oversee the asbestos and LBP abatements.

Homeowner Tank Remediation Project

Flemington, Hunterdon County, New Jersey

Brilliant Environmental Services, LLC (BES) was retained by the homeowner to provide remediation services for the release of No. 2 Heating Oil from a former 550-gallon underground storage tank. The location of the release was adjacent a one-story home and impacted soil. The remediation was completed in two days and approximately 10 tons of soil.

 

BES collected post remedial soil samples and prepared a Remedial Action Report for submittal to the New Jersey Department of Environmental Protection (NJDEP). The report was submitted through the NJDEP Voluntary Cleanup Program and No Further Action was received from the NJDEP approximately 105 days from remedial activities.
